What is an Immigration Bond?

Here’s a scenario for you: Your cousin Alejandro has been living in this country illegally for some time now. One day he’s arrested for possessing drugs. Instead of going to prison, he’s been detained by the Immigration and Custom Enforcement (ICE). Can you bail him out?

Unlike bail bonds that can help get your loved one out of jail, immigration bonds are extremely different. Although Andrew Pizzo Bail Bonds does not handle immigration bonds, we thought it would be important to discuss them.

If an undocumented immigrant is arrested, both the police and ICE will communicate to figure out whether the immigrant should be in the country. The undocumented immigrant could be detained in prison for approximately 48 hours – any longer, and the immigrant will be released.

Once in ICE custody, the deportation office will then decide whether to place the person into removal proceedings. If this occurs, it can take years to complete, especially if it’s being contested. But once the immigrant is in custody, it’s determined whether he/she can be released on bond. Just like a bond for bail, immigration bonds are determined on the following factors:

• Any risk the immigrant will missing immigration hearings
• Whether the immigrant is a danger to the community
• And whether there’s a criminal conviction on the immigrant’s record

An immigration bond can be pretty pricey – it can range anywhere from $1,500 to $25,000, depending on the circumstances.
